Roundup Weed Spray Cases to Go to Trial Over Cancer Claims

On July 10, 2018, United States District Judge Vince Chhabria issued his order holding that there was evidence from which a reasonable jury could decide that Monsanto’s widely-used Roundup herbicide causes Non-Hodgkin Lymphoma. This does not mean that the Court ruled that Roundup, in fact causes cancer. Rather, the order holds that there is sufficient evidence to allow a jury to consider and for that jury to decide whether Roundup causes cancer. Specifically, the court’s order denied Monsanto’s motions for summary judgment and to exclude the plaintiffs’ expert opinions under theĀ Daubert standard in the now-pending Multi-District Litigation over whether.

According to the the American Cancer Society, Non-Hodgkin Lymphoma is cancer of the blood that begins in the body’s white blood cells, which are part of the immune system that help fight infections and other diseases. Non-Hodgkin Lymphoma can either grow more slowly as indolent tumors or it can cause aggressive lymphomas. Unfortunately, all non-Hodgkin lymphomas have the capacity to spread to other parts of the body including the brain, liver, and bone marrow.

The primary ingredient in Roundup is a chemical called Glyphosate. Monsanto claims that Glyphosate, and by extension Roundup, is safe. But, as the Court recently ruled, there is evidence to suggest otherwise. In 2015, Roundup was branded as “probably carcinogenic” by the World Health Organization. Further, as outlined in the Court’s order finding there are other epidemiological studies supporting the proposition that Roundup causes Non-Hodgkin Lymphoma.

The evidence suggests that Roundup can enter the body through both inhalation and through contact with a person’s skin.
