Lear Werts represented a man who suffered a debilitating right knee injury while he was visiting a Lake of the Ozarks resort on a church trip with his family. The resort’s pool area and water park were not maintained in a safe condition.
Lear Werts discovered that the resort knew water would collect on the walkway surrounding the pool which caused the walkway to become slimy and slippery. This hazard posed a danger to the resort’s guests and Lear Werts’s client fell on the slimy walkway. The fall resulted in a sprained right ankle and a displaced patella fracture of his right knee, which required surgery.
Lear Werts was successful in negotiating a substantial settlement for the firm’s client prior to filing a lawsuit.
