Misleading letters from debt collectors lead to classwide settlement

Lear Werts was lead counsel in a class action representing a class of Missouri consumers under the Fair Debt Collection Practices Act (“FDCPA”). The plaintiffs alleged that the were sent letters by a debt collection law firm that misstated the amount the consumers allegedly owed. Specifically, the clients received a series of letters. The first letter stated one amount allegedly owed. The following letters allegedly overstated the amount of interest which gave the impression that the interest was accruing faster than it actually was.

The case settled on a classwide basis after the plaintiffs defeated the defendants’ motion for summary judgment.
