Lear Werts partner Todd Werts has been appointed by the United States District Court for the District of New Jersey to a leadership role in In Re: Am. Med. Collection Agency Customer Info. Data Breach Litig. on its Bankruptcy Steering Committee.
Prior to the consolidation of this multi-district litigation, Lear Werts had filed two federal class action lawsuits in the United States District Court for the District of Kansas on behalf of former Quest Diagnostic and LabCorp patients whose private health information was compromised through a massive data breach through their collection agency, American Medical Collection Agency (“AMCA”).
Shortly after reporting the breach, AMCA filed a Chapter 11 Bankruptcy case in the U.S. Bankruptcy Court for the Southern District of New York. The Bankruptcy Steering Committee is coordinating the MDL Plaintiffs’ involvement in the AMCA bankruptcy case while the claims against Quest Diagnostic, LabCorp, and the other affected laboratories are litigated in the MDL.
